Bowman County Commission

Bowman County Commissioners are elected at large on a non-partisan basis for staggered four-year terms. The County Commission is the governing body of the County responsible for overseeing County activities and working to ensure that citizen concerns are met, federal and state requirements are fulfilled, and County operations run smoothly.

The State constitution gives the Board of County Commissioners the power to adopt zoning ordinances (local laws), levy taxes, appropriations, authorize bonds, set salaries, approve bills, accept bids, approve the County budget and establish the requirements/policies for the Departments under its control.

The Board governs all unorganized townships of the County directly.

 


 

County Commission Minutes

October 01, 2019
9:00 AM

The Board of County Commissioners met in regular session on October 1, 2019, with the following present:  Rick Braaten, Lynn Brackel, Josh Buchmann and Jerry Jeffers. Pine Abrahamson was absent.  Chairman Brackel called the meeting to order at 9:02 am.  The Pledge of Allegiance was recited.

Brackel asked for corrections or additions to the agenda. Buchmann made a motion to approve, with Jeffers seconding the motion, and upon a vote, the motion was carried unanimously.

Braaten made a motion to approve the Network Support Service Contract with Consolidated Communications Corporation, with Buchmann seconding the motion.  A roll call vote was taken with all members voting aye.  Motion carried.

The following vouchers were approved by a motion made by Braaten, with Buchmann seconding the motion, and upon a vote, the motion was carried unanimously.

Jeffers made a motion to approve the September 17, 2019 minutes, with the correction.  Buchmann seconded the motion, and upon a vote, the motion was carried unanimously.

Bowman County Water Resource District Board Member Rick Seifert met to discuss the open position on the Bowman County Water Resource District Board, due to the resignation of Leland Sather.  Discussion was held with two individuals that expressed interest in becoming a board member. The commissioners will discuss the qualifications of each and decide at a later date.  

Buchmann made a motion to approve the Variance request, submitted by Scranton Equity Exchange, modifying the setback requirements for the placement of an above ground fuel tank and island, on Lots 2 and 3, Block 24, Section 26, City of Scranton.  The Bowman County Planning and Zoning Board approved the variance request on September 23, 2019, and recommended commission approval.  Braaten seconded the motion.  A roll call vote was taken with all members voting aye.  Motion carried.   

Bowman County Highway Superintendent Shane Biggs, Gary Brennan and Lucas Doerr, from Brosz Engineering met to discuss road projects.  Biggs stated that gravel may be available from several landowners living south of Rhame.

                        At 1:15 pm Chairman Brackel called the Public Hearing to order to receive public comments on the 2020 Budget. No guests appeared.  Discussion was held on the estimated county mill levies.    Braaten made a motion to approve the 2020 final budget, as presented, with Buchmann seconding the motion.  A roll call vote was taken with all members voting aye. Motion carried.  The levy limitation will be established by the budgets presented by the political subdivisions and approved by the commissioners as applicable to the North Dakota Century Code.

                        Braaten made a motion to adjourn the hearing at 1:40 pm, and recess the meeting to attend an informational session that was being held at the 4-Season Pavilion.  Buchmann seconded the motion.  A roll call vote was taken with all members voting aye.  Motion carried. 

At 3:06 pm Buchman made a motion to reconvene the meeting, with Braaten seconding the motion. 

At 3:10 pm Bowman County State’s Attorney, Andrew Weiss, met to discuss the Bowman County Water Resource District board membership. 

Upon finding that a procedural error was made when enacting the Bowman County Planning Zoning revised fee schedule, Buchmann made a motion to rescind the motions that were approved on March 19, 2019, which approval was granted for Resolutions # 8 and # 9; the approval of  the amendments to Resolution # 8 and Resolution # 9 which were approved June 4, 2019;  and the approval of Resolution # 10 on July 2, 2019, which was originally presented and approved as Resolution # 8, but due to an error in the numbering of the resolution,  Resolution # 10 replaces Resolution # 8.   Jeffers seconded the motion.  A roll call vote was taken with all members voting aye.  Motion carried.  The previous fee schedule will be in effect until the proper procedures are enacted by the Board of Bowman County Commission.  The same corrective actions will be enacted by the Bowman County Planning and Zoning Board. 

Bowman County Treasurer Anita McLaughlin met to present the September Treasurer’s Report Daily Cash Settlement/Bank Reconciliation report.  Braaten made a motion to approve, with Buchmann seconding the motion, and upon a vote, the motion was carried unanimously.

Braaten made a motion to approve the September 2019 Month-End Bureau of Land Management Report, with Jeffers seconding the motion, and upon a vote, the motion was carried unanimously.

Jeffers made a motion to approve the September 2019 report on the monthly fees collected by the Bowman County Recorder/Clerk of Court.  Braaten seconded the motion.  A roll call vote was taken with all members voting aye. Motion carried.

Braaten made a motion to approve the September 2019 report on the monthly fees collected by the Bowman County Sheriff’s department.  Buchmann seconded the motion.  A roll call vote was taken with all members voting aye. Motion carried.

Braaten made a motion to approve the following as surplus property and transfer to the Slope County Sheriff’s department: One - Smith and Wesson Model 4506-1 pistol, Serial Number TYN5082.  Jeffers seconded the motion.  A roll call vote was taken with all members voting aye. Motion carried.

Braaten made a motion to approve the following resolution, with Buchmann seconding the motion.  A roll call vote was taken with all members voting aye.  Motion carried.

WHEREAS, the Bowman County Water Resource District Board membership consists of three voting members.  The secretary position is a non-voting position.

WHEREAS, the Bowman County Commission has voted to increase the membership from three members to four members.  The members will serve at-large.  The secretary position will remain as a non-voting member.

WHEREAS, N.D.C.C. 61-16.1-07 does not specify the term length of each member.  Therefore, pursuant to the vote of the Bowman County Commission, the term of the new member will be a three-year term, and will alternate with the terms of the existing three members.

Buchmann made a motion to appoint the Nick Schaff and Chanell Walby as board members to the water resource district board, effective immediately, both will serve until December 31, 2019, at which time the three-year terms will be designated.  Jeffers seconded the motion.  A roll call vote was taken with all members voting aye.  Motion carried.    

            With no further business to discuss, Jeffers made a motion to adjourn the meeting at 5:05 pm, with Braaten seconding the motion, and upon a vote, the motion was carried unanimously.

The Bowman County Board of Commissioners generally holds its regular monthly meetings on the first and third Tuesday of each month beginning at 9:00 AM.  Meetings may be rescheduled from time to time if necessary; see the Meeting Calendar for upcoming meeting dates.

The public is welcome at every meeting.  Appointments are not required but members of the public wishing to address the board are encouraged to contact the County Auditor at (701) 523-3130 for further information.

Rick was first elected as a Bowman County Commissioner in November 2008.He is a 1975 graduate of Bowman High School and graduated from NDSU in 1979 with a BS degree in Agricultural Economics.Rick is married to Laurie Fish and they have four sons.Rick engages in farm and ranch work.

Josh graduated in 1996 from Bowman High School and attended NDSCS, graduating in 1999.  He moved back to Bowman in 2006.  He has two children; his daughter is attending NDSCS for paramedic and his son attends Bowman High School.

Jerry was elected to the Bowman County Commission in 2016 and is the third generation on the Jeffers farm in southwestern Bowman County; homesteaded in 1909.  Jerry also has operated a cabinet shop in the winter since 1976.  He has three sons and is married to Karen who has two sons and a daughter.  Between them they have 11 grandchildren.

Pine was first elected as a Bowman County Commissioner in 2004.Pine was born and raised in Bowman County.He has been engaged in agriculture his entire life; he is the third generation to be involved on the family farm and he spends many hours working with his youngest daughter and fiancé on the home place.Pine is married with 4 children and 3 grandchildren.

Lynn Brackel

Lynn was elected to the County Commission in 2008.He graduated from Dickinson State University in 1966 with a music degree and taught band and chorus for 12 years. Lynn owned a plumbing business and served the Southwest North Dakota, Montana, and South Dakota areas for over 30 years.Lynn still enjoys music and has directed the Church Choir for 30 years, Bowman County Community Band for 20 years, and Saxy Brass for 20 years.Lynn is married to Judy with 3 children and 5 grandchildren.
